Welcome to The Foam Party Guy. These Terms & Conditions govern your use of our website, quote requests, bookings, and event services. By requesting a quote, booking an event, making a payment, or using our services, you agree to these Terms & Conditions.

1. About Us

The Foam Party Guy provides foam party entertainment and related event services in Central Virginia and surrounding areas.

2. Quotes and Booking

All quotes are based on the information provided at the time of inquiry, including event type, location, crowd size, event length, timing, and any special requirements.

A booking is not confirmed until:

we approve the event,
any required deposit is received, and
you receive confirmation from us.

Quoted prices may change if event details change after the original quote is issued.

3. Pricing and Payments

Packages and services start at stated rates, but final pricing depends on the specific details of your event.

Additional charges may apply for things such as:

extended event time,
larger-than-expected attendance,
extended travel,
unusual setup requirements,
stairs, difficult access, or long hose/equipment runs,
add-ons or upgrades requested after booking.

Payment terms will be stated in your quote or invoice. Unless otherwise agreed in writing, all remaining balances are due on or before the day of the event.

Any pricing, fees, deposits, and important conditions should be read carefully before booking. Material terms should be presented clearly and conspicuously in online advertising and contracting.

4. Deposits and Cancellations

To reserve your date, we may require a non-refundable retainer or deposit.

If you cancel:

deposits or retainers are non-refundable unless we agree otherwise in writing,
payments already made may be applied only as specifically stated in your invoice or event agreement,
rescheduling is subject to availability.

If you need to reschedule, we will make reasonable efforts to move your event to a new date, but we cannot guarantee availability.

5. Weather Policy

Foam parties are outdoor events unless otherwise agreed.

Because weather can affect safety and equipment operation, we reserve the right to delay, pause, reschedule, or cancel an event due to:

lightning,
severe weather,
unsafe wind conditions,
extreme temperatures,
hazardous ground conditions,
or any condition we believe creates a safety risk.

Light rain may not require cancellation, but final weather-related decisions will be made by The Foam Party Guy.

6. Event Site Requirements

The customer is responsible for providing a safe and suitable event area.

Unless otherwise agreed, the customer must provide:

adequate open space for setup and operation,
access to a working water source,
access to electrical power if needed,
a reasonably level and safe setup area,
and clear access for loading, setup, and breakdown.

You are responsible for confirming that the event location permits foam entertainment and any related equipment use.

We may refuse setup or operation if the site is unsafe, inaccessible, or unsuitable.

7. Supervision and Safety

Adult supervision is required at all times for children’s events.

The customer is responsible for:

supervising guests,
enforcing age-appropriate participation,
ensuring participants follow instructions,
and keeping non-participants, pets, and personal property out of restricted equipment areas.

Guests must not:

climb on equipment,
tamper with hoses, cables, or power,
enter restricted setup areas,
or behave in a manner that creates a safety risk.

We reserve the right to stop or modify the event at any time if unsafe conditions exist.

8. Foam Solution and Event Conditions

We use a premium 100% hypoallergenic, 100% non-toxic, 100% dye-free, pet and grass safe foam solution. Customers are responsible for informing guests to avoid participation if they have known sensitivities, allergies, skin concerns, mobility concerns, or any condition that may make participation inappropriate.

Foam can create slippery surfaces depending on site conditions. The customer accepts responsibility for choosing an appropriate event surface and for monitoring guests accordingly.

The customer is responsible for removing vehicles, electronics, decorations, furniture, and other items that could be affected by water or foam overspray.

9. Damage to Property / Site Conditions

The customer is responsible for ensuring the event space is appropriate for foam and water-based entertainment.

The Foam Party Guy is not responsible for:

pre-existing damage,
turf or surface issues caused by poor drainage,
slippery conditions resulting from improper site selection,
damage to items left in the event area,
or problems caused by inaccurate site information provided by the customer.

10. Customer Responsibilities

By booking, you agree to:

provide accurate event details,
obtain any permissions needed for the venue,
maintain a safe event environment,
ensure adult supervision where appropriate,
and follow all setup, safety, and participation instructions.

If event details materially change before or during the event, we may adjust services or pricing accordingly.

11. Delays and Access Issues

If setup is delayed because the event area is not ready, inaccessible, or missing required water/power access, your event time may be shortened without refund unless we agree otherwise.

If access conditions are substantially different from what was represented at booking, we may:

adjust the quote,
modify the setup,
delay service,
or cancel service if necessary for safety or logistics.

12. Photography, Video, and Marketing

We may take photos or videos at events for promotional use, including on our website, social media, and marketing materials, unless you notify us in writing before the event that you do not consent.

If your event involves minors and you do not want images used for marketing, please notify us in writing before the event date.

13. Limitation of Liability

To the fullest extent permitted by law, The Foam Party Guy is not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your booking, event, website use, or participation in our services.

Our total liability for any claim related to a booking or event shall not exceed the amount actually paid to us for that event.

Nothing in these Terms is intended to waive liability where waiver is prohibited by law.

14. Indemnification

You agree to indemnify and hold harmless The Foam Party Guy, its owner, employees, contractors, and representatives from claims, damages, losses, or expenses arising out of:

inaccurate information you provide,
unsafe site conditions,
lack of supervision,
guest misconduct,
or your breach of these Terms & Conditions.

15. Website Use

All content on our website, including text, photos, branding, graphics, and logos, is the property of The Foam Party Guy unless otherwise stated. You may not copy, reproduce, or use our content without written permission.

16. Electronic Acceptance

You agree that approvals, payments, electronic signatures, checkbox acknowledgments, emails, and other electronic records may be used in connection with quotes, bookings, and agreements. Under Virginia law, an electronic record or signature cannot be denied legal effect solely because it is electronic.

17. Governing Law

These Terms & Conditions are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

18. Changes to These Terms

We may update these Terms & Conditions from time to time. The current version will be posted with the effective date above.
